Application to Set Aside SIAC Awards Dismissed

In a judgment handed down on 31 January 2022, a three-judge panel of the Singapore International Commercial Court has dismissed three applications to remove a presiding arbitrator in an SIAC arbitration for apparent bias and to set aside two awards (in respect of claims of some US$5 billion) on grounds that the awards exceeded the scope of submission to jurisdiction, were decided in breach of natural justice or the parties’ agreed arbitral procedure.

Toby Landau KC and Colin Liew acted for the successful Defendants, instructed by Herbert Smith Freehills LLP.
