Matthew Gearing KC acted as lead counsel for the Defendant, Mason Capital, in proceedings brought by the Republic of Korea before the Singapore International Commercial Court to seek to set aside an award rendered in Mason’s favour in an investment treaty arbitration under the terms of the US/Korea FTA relating to governmental interference to support a merger between two companies in the Samsung group in 2015. The SICC handed down its judgment yesterday. Matthew’s clients prevailed with the award being upheld in full.
